Rural Zoning District Minor Commercial Changes

The Board of County Commissioners has scheduled a Public Hearing on September 2, 2014 at 6:00 p.m. at the Leon County Commission Chambers (301 S. Monroe St, 5th floor) to consider an ordinance affecting properties at the intersections of “local and arterial,” “collector and collector” and “collector and arterial” roadways within the Rural (R) zoning district.

If adopted, the ordinance would eliminate any ability to establish commercial uses at the intersection of local and arterial roads (approximately 196 locations).  Furthermore, the proposed ordinance would establish additional restrictions for minor commercial development at the intersections of collector and collector and collector and arterial roadways (approximately 39 locations total).  Minor commercial intersections are currently defined by the Tallahassee-Leon County Comprehensive Plan (Future Land Use Element - Objective 3.1, Policy 3.1.2 A.1.b.) and Section 10-6.619(b) of the Leon County Land Development Code (Chapter 10, Code of Laws).

On July 8, 2014, the Board of County Commissioners conducted the 1st of two Public Hearings regarding the proposed ordinance and scheduled the 2nd Public Hearing for September 2, 2014.  In addition to the Public Hearings, staff presented the proposed ordinance to the Development Support and Environmental Management (DSEM) Citizen’s User Group on July 15, 2014, and most recently to the Planning Commission for consistency review at a Public Hearing on August 5, 2014.  The Planning Commission found the proposed ordinance consistent with the Comprehensive Plan subject to minor changes to the proposed restrictions.
